1. Agreement

By purchasing, accessing, or using any web design or development service offered by Floatmybiz ("we," "us," "our"), you ("Client") agree to be bound by these Terms of Service. These terms apply to all website design packages, development services, add-ons, and related services purchased through our website, funnel pages, or checkout pages.

2. Services

Floatmybiz provides website design, website development, landing page creation, website optimization, and related digital services as described in the selected package at the time of purchase.

Services are performed based on the package selected at checkout. Any service not included in the selected package requires a separate written agreement or add-on approval.

We may make recommendations regarding your website, content, or online presence. Unless expressly included in your package, implementation of those recommendations is not included in the service.

3. Scope of Work and Revisions

The scope of work is defined by the package selected at checkout or a separate written project brief. Revisions are limited to the number specified in your package. Requests that fall outside the agreed scope will be quoted separately.

A revision is defined as a minor change to existing approved content or design. Structural redesigns, new pages, or significant changes in direction after a design has been approved are considered out of scope.

4. Client Responsibilities

You agree to provide all content, images, copy, branding assets, and account access required for us to complete your project in a timely manner. This includes access to your domain registrar, existing hosting accounts, and any relevant third-party platforms.

Project timelines are estimates and depend on timely feedback and approvals from you. Delays caused by failure to provide materials, access, or approvals are not the responsibility of Floatmybiz and may result in timeline extensions or additional fees.

You are responsible for reviewing all deliverables and approving them in writing before launch. Once approved and launched, additional changes are subject to revision limits or billed separately.

5. Payment and Billing

By completing a purchase, you authorize Floatmybiz to charge your payment method for the fees shown at checkout. Project-based fees are due as outlined at checkout, which may include a deposit prior to work beginning and a final payment prior to site launch.

Recurring maintenance or hosting plans are billed monthly or annually depending on the option selected. For monthly plans, billing occurs on or around the same date each month. For annual plans, billing occurs as a single payment at the start of each term.

All fees are non-refundable unless otherwise stated in writing. Floatmybiz reserves the right to pause or withhold delivery of work if payment is not received when due.

Price changes will be communicated in advance with reasonable notice.

6. Intellectual Property

Upon receipt of full payment, you own the final website design and content created specifically for your business, excluding any pre-existing tools, frameworks, templates, or third-party assets used in the build.

Floatmybiz retains ownership of all internal processes, systems, code libraries, and design frameworks used in delivering services. These may be reused in other client projects.

You retain full ownership of your business content, logos, trademarks, and materials provided to us. By submitting materials, you confirm you have the rights to use them and grant us permission to incorporate them into your project.

Third-party themes, plugins, and stock assets used in your project are subject to their respective licenses. Responsibility for ongoing licensing fees for third-party software is yours unless expressly stated otherwise in writing.

7. Hosting and Domain

Unless expressly included in your package, Floatmybiz does not provide hosting or domain registration services. You are responsible for maintaining your own hosting account and domain registration.

If hosting or domain management is included in your package, it will be described at checkout. If you cancel a plan that includes hosting, your website may be taken offline. Floatmybiz is not responsible for data loss resulting from account cancellations.

8. Third-Party Platforms

Floatmybiz may use third-party tools, platforms, or plugins to build and deliver your website. We are not responsible for changes, outages, policy updates, or discontinuation of any third-party platform or plugin.

Any third-party software, subscription, or platform fees are the responsibility of the Client unless expressly stated otherwise in writing.

9. No Guarantee of Results

Floatmybiz does not guarantee specific business outcomes, traffic levels, lead volume, or revenue results from your website. Website performance depends on many factors outside our control including your market, your content, and how the site is used and promoted after delivery.

Any examples, timelines, or prior results discussed are for informational purposes only and are not guarantees of future performance.

10. Term and Cancellation

Service agreements begin on the date of first payment. For ongoing plans, the initial term and cancellation terms are as described at checkout or in the service agreement.

Cancellation requests must be submitted in writing to [email protected]. Early termination fees may apply as outlined in your signed service agreement.

11. Limitation of Liability

To the fullest extent permitted by law, Floatmybiz's total liability for any claim arising from these terms or our services shall not exceed the total fees paid by you in the three months prior to the claim.

Floatmybiz is not liable for any indirect, incidental, consequential, or punitive damages including lost revenue, lost profits, or loss of business opportunity.

12. Indemnification

You agree to defend and hold harmless Floatmybiz and its owners, employees, and contractors from any claims, damages, or expenses arising from your business operations, content you provide, or your misuse of our services or deliverables.

13. Confidentiality

Both parties agree to keep confidential any non-public business or operational information shared in connection with the services. This obligation does not apply to information that becomes publicly available through no fault of either party.

14. Electronic Agreements

By completing a purchase through our checkout page or funnel, you agree that electronic acceptance, electronic signatures, and online order confirmations constitute valid and binding agreements to the same extent as original signatures.

15. Governing Law

These terms are governed by the laws of the State of Michigan, United States. Any disputes shall be resolved exclusively in the state or federal courts located in Muskegon, MI.

16. Changes to These Terms

Floatmybiz reserves the right to update these Terms of Service at any time. Updates will be reflected by the date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
